Well Mom, Dad and my uncles turned out at the candle light vigil in Ipoh to support the abolish ISA movement. As Mom put it, &quot;We just wanted to give those indomitable tireless champions and activists some support and put some 'action' into all our talk&quot;. Way to go Mom and Dad! Would have love to have joined you guys to show my support too.

Does this verdict imply that the judiciary has regain some independence from the executive in their decisions? Maybe Justice Syed Ahmad Helmy Syed Ahmad isn't a fan of UMNO or Najib? Will botak just slam him back to Kamunting on some other silly and unfounded charge?

Or is there still an unseen hand still controlling the courts? Now that Najib has won the presidency unopposed, could UMNO be so arrogant and confident that the tide has swung back to their favor that they're willing to let RPK as he's no longer a threat? Or are they just trying to appease the public? Or did Bodowi &amp; KJ let the cat out of the bag to piss Najib off?

The first thing that came to mind when I heard the news on radio that Barrack Obama is the &#60;span style="font-style: italic"&#62;first black president&#60;/span&#62; of the US of A was - Gee, why's he now the first &#60;span style="font-style: italic"&#62;black&#60;/span&#62; president when just before the election they were going on about how he's only &#60;span style="font-style: italic"&#62;half black&#60;/span&#62;. It just seemed like the democrats still had to convince white Americans that he's still half white, so it's not a cardinal sin to vote for him or something. Now that he's won, to make it even more historic, he shall be proclaimed the first black president.

Okok, they're still not ready for a full-fledge black president. One step at a time I guess? It just goes to show that even in the US, race is still an issue at back of everyone's head.

But ultimately, I'm happy that Obama won. Enough of the Republicans and their thirst for war. It's been 8 long years with that idiot in the office. Gotta say McCain was incredibly gracious with his defeat. Hat's off to the old man.

So when's Malaysia going to get our own &quot;Obama&quot;? I'm completely disheartened now that it all seems as if this are swinging back to the &quot;old days&quot; of Mahathirism. UMNO cronies get away with everything. Anwar's pretty much going the way of Ku Li - quietly into oblivion. Najib has won the UMNO presidency uncontested and is set to be the next PM of Malaysia...

But mostly what's legal is ethical, in the context of politics. Because politics, my dear girl, is not about what is ethical or desirable, but what is practical and acceptable. I mean, you can talk about ethics in the classroom. It's different, you know, we can talk about it as a subject or a discourse or as an idea, but I'm talking in the context of political play, of political values.

Do you think the Sabah government today is ethical? Because it stems from crossovers as well. The whole Barisan idea, the whole Barisan government, is the product of a crossover. If you view it very strongly that it's bad, then... I earlier suggested anti-hopping legislation because I thought it's not desirable, so you should not allow people to cross. But nobody in the BN wants that, either. So if you don't want this and you don't want that, that means you really want what we have today, which is a system that allows for crossovers.

&#60;span style="font-weight: bold"&#62;Politicians want it. I'm not sure everybody wants it. &#60;/span&#62;

No, because we also have a constitutional amendment - that is thanks to Mahathir again - that once an MP resigns, he cannot contest for five years. So that limits his choice. If the constitution has made it so difficult for an MP to resign, then it is only fair for the MP to be allowed to cross over.

Another reason why crossing isn't such a bad idea is because the MP has a mandate from the people to do certain things, including crossing over if that's what the people want.

&#60;span style="font-weight: bold"&#62;One of the justifications is that it's a necessity now because it is impossible to win any other way. But even with all the restrictions that have been in place by the BN government in the last elections, we still saw four new states fall to the opposition; we still saw the BN denied its two-thirds majority in Parliament. So the ballot box is still very powerful. Why justify crossovers if this can still work? &#60;/span&#62;
&#60;br /&#62;

To cross over is the right of the MP. You must not assume that the MP doesn't have a duty that he must discharge in a certain way. You must not assume that you know better than him. He is an elected Member of Parliament with the people's mandate.
&#60;br /&#62;

If the people in a particular constituency do not want a particular policy, and they say to the MP: &quot;You must oppose it.&quot; What does he do? He can't resign, because he has a duty to the people to oppose the policy. But if the mandate from the constituency is: &quot;We allow you to cross&quot;, then the MP has a duty to consider his constituency's demands.
&#60;br /&#62;

&#60;br /&#62;
You cannot assume that the crossing is done &quot;purely for personal reasons&quot;. I mean, you must also be fair that not everybody crosses &quot;purely for personal reasons&quot;. It could be because the people in the constituency want the MP to do it, and the MP has his own judgment.

So that's why I'm asking for a repeal [of the ISA]. You see, Parliament is a system, and you cannot just judge by what you see here. In other parliamentary systems, they allow crossovers. So if other countries see it fit... Of course, some countries don't allow it, there are some countries that have anti-hopping [laws], one or two countries. But most mature democracies allow it. So you have to look at the parliamentary system as a whole, so if they allow it and they think it's not so bad...

Even when they had to enact the Internal Security Act (ISA) 1960, they were very cautious and apologetic about it. Tunku stated clearly that the Act was passed to deal with the communist threat.

&quot;My cabinet colleagues and I gave a solemn promise to Parliament and the nation that the immense powers given to the government under the ISA would never be used to stifle legitimate opposition and silent lawful dissent&quot;, was what the Tunku said.

Our third prime minister, Tun Hussein Onn, reinforced this position by saying that the ISA was not intended to repress lawful political opposition and democratic activity on the part of the citizenry.

The events of the last three weeks have compelled me to review the way in which the ISA has been used. This exercise has sadly led me to the conclusion that the government has time and time again failed the people of this country in repeatedly reneging on that solemn promise made by Tunku Abdul Rahman.

This has been made possible because the government and the law have mistakenly allowed the minister of home affairs to detain anyone for whatever reason he thinks fit. This subjective discretion has been abused to further certain political interests.

History is the great teacher and speaks volumes in this regard. Even a cursory examination of the manner in which the ISA has been used almost from its inception would reveal the extent to which its intended purpose has been subjugated to the politics of the day. 
&#60;br /&#62;
 
&#60;br /&#62;
Regrettably, Tunku Abdul Rahman himself reneged on his promise. In 1965, his administration detained Burhanuddin Helmi, the truly towering Malay intellectual, a nationalist who happened to be a PAS leader. He was kept in detention until his death in 1969. Helmi was a political opponent and could by no stretch of the imagination be considered to have been involved in the armed rebellion or communism that the ISA was designed to deal with.
&#60;br /&#62;

&#60;br /&#62;
This detention was an aberration, a regrettable moment where politics had been permitted to trump the rule of law. It unfortunately appears to have set a precedent and many detentions of persons viewed as having been threatening to the incumbent administration followed through the years.
&#60;br /&#62;

&#60;br /&#62;
Even our literary giant, 'sasterawan negara' the late Tan Sri A Samad Ismail was subjected to the ISA in 1976. How could he have been a threat to national security? 
&#60;br /&#62;

&#60;br /&#62;
I need not remind you of the terrible impact of the 1987 Operasi Lalang. Its spectre haunts the government as much as it does the peace-loving people of this nation, casting a gloom over all of us. There were and still are many unanswered questions about those dark hours when more than a hundred persons were detained for purportedly being threats to national security. Why they were detained has never been made clear to Malaysians.
&#60;br /&#62;

&#60;br /&#62;
Similarly, no explanation has been forthcoming as to why they were never charged in court. Those detainees included amongst their numbers senior opposition members of parliament who are still active in Parliament today.
&#60;br /&#62;

&#60;br /&#62;
The only thing that is certain about that period was that Umno was facing a leadership crisis. Isn't it coincidental that the recent spate of ISA arrests has occurred when Umno is again having a leadership crisis?  
&#60;br /&#62;

&#60;br /&#62;
In 2001, Keadilan 'reformasi' activists were detained in an exercise that the Federal Court declared was in bad faith and unlawful. The continued detention of those that were not released earlier in the Kamunting detention facility was made possible only by the fact that the ISA had been questionably amended in 1988 to preclude judicial review of the minister's order to detain.
&#60;br /&#62;

&#60;br /&#62;
Malaysians were told that these detainees had been attempting to overthrow the government via militant means and violent demonstrations. Seven years have gone and yet no evidence in support of this assertion has been presented. Compounding the confusion even further, one of these so-called militants, Ezam Mohamad Noor, recently rejoined Umno to great fanfare, as a prized catch it would seem. 
&#60;br /&#62;
 
&#60;br /&#62;
At around the same time, members of PAS were also detained for purportedly being militant and allegedly having links to international terrorist networks. Those detained included Nik Adli, the son of Tuan Guru Nik Abdul Aziz Nik Mat, the menteri besar of Kelantan. Malaysians were made a promise by the government that evidence of the alleged terrorist activities and links of these detainees would be disclosed. To date no such evidence has been produced.  
&#60;br /&#62;
 
&#60;br /&#62;
The same formula was used in late 2007 when the Hindraf 5 were detained. Malaysians were told once again that these individuals were involved in efforts to overthrow the government and had links with the militant Liberation Tiger of Tamil Eelam of Sri Lanka. To date no concrete evidence have been presented to support this assertion.
&#60;br /&#62;

&#60;br /&#62;
It would seem therefore that the five were detained for their involvement in efforts that led to a mobilisation of Indian Malaysians to express, through peaceful means; their frustration against the way in which their community had been allowed to be marginalised. This cause has since been recognised as a legitimate one. The Hindraf demonstration is nothing extraordinary as such assemblies are universally recognised as being a legitimate means of expression. 
&#60;br /&#62;
 
&#60;br /&#62;
In the same vein, the grounds advanced in support of the most recent detentions of Tan Hoon Cheng, Teresa Kok and Raja Petra Kamarudin leave much to be desired. The explanation that Tan Hoon Cheng was detained for her own safety was farcical. The suggestion that Teresa Kok had been inciting religious sentiments was unfounded as was evinced by her subsequent release. 
&#60;br /&#62;

&#60;br /&#62;
As for Raja Petra Kamarudin, the prominent critic of the government, a perusal of his writings would show that he might have been insulting of the government and certain individuals within it.
&#60;br /&#62;

&#60;br /&#62;
However, being critical and insulting could not in any way amount to a threat to national security. If his writings are viewed as being insulting of Islam, Muslims or the Holy Prophet (pbuh), he should instead be charged under the Penal Code and not under the ISA.
&#60;br /&#62;

&#60;br /&#62;
In any event, he had already been charged for sedition and criminal defamation in respect of some of his statements. He had claimed trial, indicating as such his readiness and ability to defend himself. Justice would best be served by allowing him his day in court more so where, in the minds of the public, the government is in a position of conflict for having been the target of his strident criticism.  
&#60;br /&#62;

&#60;br /&#62;
The instances cited above strongly suggest that the government is undemocratic. It is this perspective that has over the last 25 plus years led to the government seemingly arbitrarily detaining political opponents, civil society and consumer advocates, writers, businessmen, students, journalists whose crime, if it could be called that, was to have been critical of the government.
&#60;br /&#62;

&#60;br /&#62;
How it is these individuals can be perceived as being threats to national security is beyond my comprehension. The self-evident reality is that legitimate dissent was and is quashed through the heavy-handed use of the ISA. 
&#60;br /&#62;

&#60;br /&#62;
There are those who support and advocate this carte-blanche reading of the ISA. They will seek to persuade you that the interests of the country demand that such power be retained, that Malaysians owe their peace and stability to laws such as the ISA. This overlooks the simple truth that Malaysians of all races cherish peace. We lived together harmoniously for the last 400 years, not because of these laws but in spite of them.
&#60;br /&#62;

&#60;br /&#62;
I believe the people of this country are mature and intelligent enough to distinguish actions that constitute a 'real' threat to the country from those that threaten political interests. Malaysians have come know that the ISA is used against political opponents and, it would seem, when the leadership is under challenge either from within the ruling party or from external elements. 
&#60;br /&#62;
 
&#60;br /&#62;
Malaysians today want to see a government that is committed to the court process to determine guilt or innocence even for alleged acts of incitement of racial or religious sentiment. They are less willing to believe, as they once did, that a single individual, namely the minister of home affairs; knows best about matters of national security.
&#60;br /&#62;

&#60;br /&#62;
They value freedom and the protection of civil liberties and this is true of people of other nations too.  
&#60;br /&#62;

&#60;br /&#62;
Mr Prime Minister, the results of the last general election are clear indication that the people of Malaysia are demanding a reinstatement of the rule of law. I was appointed as your, albeit short-lived, minister in charge of legal affairs and judicial reform.
&#60;br /&#62;

&#60;br /&#62;
In that capacity, I came to understand more keenly how many of us want reform, not for the sake of it, but for the extent to which our institutions have been undermined by events and the impact this has had on society. 
&#60;br /&#62;
 
&#60;br /&#62;
With your blessing, I attempted to push for reform. High on my list of priorities was a reinstatement of the inherent right of judicial review that could be enabled through a reversion of the key constitutional provision to its form prior to the controversial amendment in 1988.
&#60;br /&#62;

&#60;br /&#62;
I need not remind you that that constitutional amendment was prompted by the same series of events that led not only to Operasi Lalang but the sacking of the then Lord President and two supreme court justices.
&#60;br /&#62;

&#60;br /&#62;
Chief amongst my concerns was the way in which the jurisdiction and the power of the courts to grant remedy against unconstitutional and arbitrary action of the executive had been removed by Parliament and the extent to which this had permitted an erosion of the civil liberties of Malaysians.
&#60;br /&#62;

&#60;br /&#62;
It was this constitutional amendment that paved the way for the ouster provision in the ISA that virtually immunises the minister from judicial review, a provision which exemplifies the injustice the constitutional amendment of 1988 has lent itself. 
&#60;br /&#62;
 
&#60;br /&#62;
I also sought to introduce means by which steps could be taken to assist the judiciary to regain the reputation for independence and competence it once had. Unfortunately, this was viewed as undesirable by some since an independent judiciary would mean that the executive would be less 'influential'.
&#60;br /&#62;

&#60;br /&#62;
I attempted to do these things and more because of the realisation that Malaysia's democratic traditions and the rule of law are under siege. Anyway, there is nothing wrong with giving everyone an independent judiciary and the opportunity to a fair trial.
&#60;br /&#62;

&#60;br /&#62;
This is consistent with the universal norms of human rights as it is with the tenets of Islam, the religion of the federation. Unchecked power to detain at the whim of one man is oppressiveness at its highest. Even in Israel, a nation that is perpetually at war the power to detain is not vested in one man and detention orders require endorsement from a judge.  
&#60;br /&#62;
 
&#60;br /&#62;
If there are national security considerations, then these can be approached without jettisoning the safeguards intended to protect individual citizens from being penalised wrongfully. In other jurisdictions involved in armed conflicts, trials are held in camera to allow for judicial scrutiny of evidence considered too sensitive for public disclosure so as to satisfy the ends of justice.
&#60;br /&#62;

&#60;br /&#62;
If this can be done in these jurisdictions, why not here where the last armed struggle we saw, the very one that precipitated the need for the ISA, came to an end in the 1980s?
&#60;br /&#62;

&#60;br /&#62;
Any doubts as to the continued relevance of the ISA in its present form should have been put to rest by the recommendation by the Human Rights Commission (Suhakam) that the ISA be repealed and an anti-terror legislation suited to the times enacted in its place. Containing as it did a sunset clause in its original times, the ISA was never intended to be a permanent feature on the Malaysian legal landscape. 
&#60;br /&#62;
 
&#60;br /&#62;
Through its continued use in the manner described above and in the face of public sentiment, it is only natural that the ISA has become in the mind of the people an instrument of oppression and the government is one that lends itself to oppressiveness.
&#60;br /&#62;

&#60;br /&#62;
Its continued use does not bode well for a society that is struggling to find its place in the global arena. It does not bode well for the democracy that is so vital for us to develop sustainably.  
&#60;br /&#62;

&#60;br /&#62;
Mr Prime Minister, I remember very clearly what you once said; that if one has the opportunity to do what is good and right for the country, then he must take on the task. I respect you deeply for that and if I were confident that I would have been able to do some good for Malaysia, I would have remained on your team.
&#60;br /&#62;

&#60;br /&#62;
Sir, you are still the prime minister and you still have the opportunity to leave your footprint in Malaysian history. I urge you to do so by repealing the ISA once and for all.  
&#60;br /&#62;
 
&#60;br /&#62;
Let us attempt to fulfil that solemn promise made by our beloved first prime minister to the people of this country.

The political landscape in Malaysia has kind gone back to what it was before, 1-2 years ago. I'm tired of the UMNO shenanigans and internal squabbling. To me, they've become completely irrelevant and I could not care less anymore about what happens within UMNO. Najib, Muhyiddin, or Ku Li as president, it just means squat. Frankly, it all just disgusts me. All I want is that they be out of the government.

Then the opposition has lost significant momentum in toppling the BN government since Anwar missed his self-imposed deadline and has completely backtracked and isn't commited to any date now. I know the story is they're trying to do things constitutionally, but that was a dangerous game of poker Anwar played. I could not for the life of me see Abdullah just rolling over and playing dead and letting PR just take over the government. BN called his bluff and Anwar has lost significant momentum. The momentum's gone and everyone's attention is on UMNO again. Now the only option is to see the King. I'm still optimistic about a PR government under Anwar's leadership though.

Then there's RPK getting sent to Kamunting for 2 years detention under ISA. I can't help but feel that things are different in the blogosphere. 			<description>So September 16th has come and gone with relative quietness. There has been so much anticipation of this date that we'd have a new government in Malaysia by now. Well, today has been like any other day honestly, just that all the local news portal servers have been slow under the increased load of curious surfers looking for juicy tidbits and news on a takeover.

What impact would this have on Anwar's credibility? No doubt KJ, Kerismuddin, Bodowi, Najib, Nazri and the rest of UMNO would take full advantage of this issue and exploit it to the fullest. But honestly? I think people want change so much the date is of little significance. Missing the deadline really isn't going to do anything to change people's perception on the current situation. People just want UMNO out. I see an ancient and obsolete regime flailing and desperately throwing out any weapons it has at its disposal to ensure its survival. With each attempt, it's finding that these old tactics are outdated and are just backfiring.

The senile Dr. M has again been awfully presumptuous by saying that Malaysian Chinese do not reject race politics and only just want Bodowi out. I, as a Malaysian Chinese, reject UMNO and do not want them running this country with their racist, gansterism, fear-mongering, style of politics. Enough is enough. The problem with UMNO is they keep hanging on to their version past and how things have &quot;historically&quot; happened. Y'know what, I don't give a fuck what happened. The situation and climate now is different. We are a multi-racial and democratic nation. Well, there has been a resounding voice demanding for change with March 8th and Permatang Pauh. No, they were not rejections of just only Bodowi. They were rejections of UMNO. They were calls for change.

I laud Zaid Ibrahim for resigning from his post as Law Minister for blatant misuse and abuse of the ISA. The next thing he should do is quit UMNO. Bodowi just sounds like a typical &quot;boss&quot; who just rejects the resignation and counter offers with a holiday, on the grounds that he could be &quot;tired&quot;. Now where have I heard that happen before? Hmmm... Funny how there are a lot of times I can draw parallels between national politics and the politics at work. I should just blog about that one of these days. I think some things are just so deeply ingrained in the Malaysian culture.

Anyway, just going off tangent for a bit there. I don't have much to add that hasn't already been said about Malaysia day, the ISA, the cat and mouse game between Anwar and Abdullah, and how my intelligence has been insulted by a certain botak minister by other blogs. So I'll just leave it as that.

I hope you guys had a Happy Malaysia day. To those of you who believe, carry on hoping and don't give up. I personally don't care how long Anwar takes to topple the BN government (but don't take too long, please) as long as it gets done. BN seems to be doing a good job at toppling themselves these days by further disconnecting themselves with the people and they don't really need Anwar to do that for them anyway.

I do believe if it takes time to get something right, then don't rush it through. Take the time to do it right. If Anwar and gang needs time to ensure a smooth transition with no more random arrests and (heaven forbid) violence on the streets, let them do it their way.

			<title>Weekend at Barcelona</title>

			<description>Ah, Barcelona. Beautiful weather. Beautiful people. Beautiful place. The architecture is quite different from those in Britain and France. Gothic, mediterranean, gaudy, majestic are a few words that come to mind, but interesting none-the-less. There are a lot colorful buildings with curvy elements and bright tiles, which I believe earns Barcelona the title of the Glittering Jewel of the Mediterranean.
&#60;br /&#62;

&#60;br /&#62;
A lot of the gaudy architecture around Barcelona is attributed to their most famous architect, Antoni Gaudi. You can read more about him over at this &#60;a href="http://en.wikipedia.org/wiki/Antoni_Gaudi" target="_blank" class="postlink"&#62;wiki&#60;/a&#62;. Some of his most famous landmarks around Barcelona are Segrada Familia, La Padrera, Casa Batllo, Parc Guell, and many more. His trademark style is recognizable and he is said to get his inspiration from nature. You'll notice the lack of straight lines in all of his creations. He sure was obsessed with putting bright colored tiles on all his buildings too. I can't help but wonder about etymology of the English word &quot;Gaudy&quot; and whether it comes from his name, &quot;Gaudi&quot;.

So my attempts at speaking Spanish were laughable. I had my first attempt at speaking Spanish when I went for breakfast. I tried to order in English at first for a spanish omelette and coffee, but the lady didn't understand me. It didn't strike me that she didn't understand me initially since she kept nodding her head and saying &quot;Si&quot;. I think she only understood coffee and repeated out, &quot;cafe?&quot; and then she asked me &quot;solo?&quot;. Presuming she meant &quot;just one?&quot;, I said &quot;Si&quot;. She gave me a shot of espresso instead of coffee... but it was good espresso anyway. After waiting for about ten minutes I realized she didn't get my order for an omelette either. I finally looked through my phrasebook and asked for &quot;La carta&quot; (the menu), and pointed out the omelette that I wanted. It was pretty good actually.

I personally find the Spanish more friendly than the British and definitely the French. Everyone just presumes you speak Spanish, like this old guy sitting next to me as I waited for a Metro. He just starts shaking my hand and going on and on about something I had no idea and the first thing that came to my mind was how badly his teeth were stained. He didn't seem dodgy, so I just said &quot;No comprende&quot; and I don't speak Spanish. He asked me a few more questions in Spanish, kinda like in disbelief that I don't or something.

Finally he managed to think of something English to say, &quot;What country? Where are you from?&quot;. I said Malaysia, and he goes &quot;Ah&quot;, and I think that got lost on him since he probably had no idea where Malaysia is. Then he goes and talks to the guy on the other side of him. But I still saw a number of Chinese and Indians there so I guess it's normal to asume that an Asian would speak Spanish there.

I'd say Barcelona is a very walkable city just to sight-see, but don't forget to bring your sunscreen if you're there in summer... like I did. It's quite easy to get lost though since there are a number of roads that kind of cut through diagonally, and road signs are almost non-existent most of the time. I wonder how do they find their way around. On the Metro, it isn't as efficient as the London Tube or French Metro, but still 100x better than Malaysian LRT.

There's a safety aspect I guess, so that pedestrians and blind people can hear the car, but it still just sounds and feels silly. It's like, cutting off the balls of the car and putting some prosthetic testicles in instead. I just have images of a kid cycling on his bike screaming &#60;span style="font-style: italic"&#62;vroom vroom&#60;/span&#62; with a slow crescendo as he picks up speed.

Driving around UK, I've seen a number of hybrids on the road. Not that I can hear them, but y'know what... most of the time I can't hear the regular petrol cars outside when I'm driving anyway, unless a V8 pulls up next to me or something. Don't drivers rely more on visual than aural?

At pages 174 and 175 of its report presented to Your Majesty on 9th May, 2008, the Royal Commission of Inquiry mandated to look into the matter of the VK Lingam video, in recommending the formation of a Judicial Appointments Commission, observed as follows:

'...there is cause for concern about how judges in the upper echelons of the judiciary were appointed and the selection criteria employed. More specifically the evidence has disclosed inherent flaws and weaknesses regarding the process of appointment and promotion of High Court judges as well as the Chief Judge Malaya, President Court of Appeal and the Chief Justice of the Federal Court...Having heard the evidence presented to the Commission in relation to the video clip it would seem clear that the appointment and promotion of judges of the higher judiciary is open to interference and manipulation by the Executive and other extrinsic forces including private citizens...the inherent weaknesses in the process of appointment of judges and its vulnerability to interference and manipulation could result in extreme damage to the independence of the judiciary in particular and to the country in general'.

We, the rakyat, have been very anxious that the requisite reforms to the Judiciary be given effect to so as to restore the same as a truly independent arm of government, free from any sort of interference from Executive so that the former could perform its constitutional role as the defender of the rakyat. We were as such gratified with the media reports that the Law Minister, Dato Zaid Ibrahim, was treating the matter of the establishment of a Judicial Appointments Commission as a matter of priority. 
&#60;br /&#62;

We, the rakyat, are now gravely disappointed with recent media reports that several Cabinet ministers, notably from UMNO, have rejected the proposal by the Law Minister for the establishment of the Judicial Appointments Commission and that the Law Minister had recently confirmed that there would now not be sufficient time during the present sitting of Parliament to table a bill for the purposes of establishing the Judicial Appointments Commission. 
&#60;br /&#62;

We, the rakyat, also note and endorse the concerns of the Law Minister that the appointment to the post of Chief Justice, which falls vacant on 18th October, 2008 upon the retirement of the present Chief Justice Tun Abdul Hamid Mohamad, should ideally be done as transparently as might have been had the Judicial Appointments Commission been set up and entrusted with that task.

We, the rakyat, note that in September last year, the Prime Minister had recommended and Your Majesty had consented to the appointment of Tan Sri Dato' Zaki Tun Azmi directly to the Federal Court, by-passing several senior judges of the Court of Appeal.

Then in December last year, whilst Tan Sri Dato' Zaki had barely completed three months into his appointment as a judge of the Federal Court, the Prime Minister had again recommended and Your Majesty had consented to the appointment of Tan Sri Dato' Zaki to the position of President of the Court of Appeal, this time bypassing several far more senior judges of the Federal Court. 
&#60;br /&#62;

We, the rakyat, note with concern that the rapid rise of Tan Sri Dato' Zaki through the judiciary, inexplicably over the heads of many more senior members, is reminiscent of the episode in which Tun Ahmad Fairuz Sheikh Abdul Halim bypassed the more senior late Tan Sri Malek Ahmed to the position of President of the Court of Appeal, an episode that became the subject-matter of scrutiny by the Royal Commission of Inquiry earlier this year. 
&#60;br /&#62;

&#60;br /&#62;
We, the rakyat, also note with concern the following of and concerning Tan Sri Dato' Zaki : 
&#60;br /&#62;

&#60;br /&#62;
1.Tan Sri Dato' Zaki is the most junior judge amongst all judges of the High Courts, the Court of Appeal and the Federal Court; 
&#60;br /&#62;

&#60;br /&#62;
2.Tan Sri Dato' Zaki is the most junior amongst the 8 Federal Court judges, and his selection as President of the Court of Appeal would most unfairly have raised questions about the competence of the other 7 very much more senior judges of the Federal Court ; 
&#60;br /&#62;

&#60;br /&#62;
3.Tan Sri Dato' Zaki has been very intimately involved in UMNO, having at one time held the position of chairman of the party's election committee, deputy chairman of its disciplinary board of appeal and party legal adviser. It is unclear if he is still a card carrying member of UMNO or if he has ceased to be one, when he ceased to be one; 
&#60;br /&#62;

&#60;br /&#62;
4.Tan Sri Dato' Zaki has been linked to financial scandals involving UMNO that were allegedly bailed out by the government; 
&#60;br /&#62;

&#60;br /&#62;
5.Tan Sri Dato' Zaki has been very intimately involved in the corporate world as a major shareholder and / or director in several corporate entities, many of which were known to have business dealings with the government; and 
&#60;br /&#62;

&#60;br /&#62;
6.Tan Sri Dato' Zaki had previously been embroiled in a personal scandal that implicated him in the destruction of documentary evidence, thus laying him open to questions of his integrity.
&#60;br /&#62;

&#60;br /&#62;
We, the rakyat, in writing to Your Majesty now, are guided by the following wise words of HRH Raja Nazrin Shah on 9th April, 2008 :

'We are now at a critical time in our nation's history, one where the institutions of state - indeed, the foundations of our democracy - which we have built up since Independence, are under scrutiny. The just concluded 12th General Elections has ushered in a host of changes. Among other things, it has introduced a greater degree of contestation in policy-making, legislation and administration than many would previously have thought possible. Some of these changes may be transient. Others could well be permanent. Whatever the case, the new political realities have proven to be and will continue to be challenging. They send a clear message that we cannot continue on a course of 'business-as-usual'. It goes without saying that recent revelations of improprieties in the judiciary have been extremely damaging, not least by eroding the public's image of, and confidence in, the system of justice in this country. We must be committed to working through our current problems and to emerge the stronger and better for them. In order to do so, we must be prepared to deal with the facts as they are, and not as we would like them to be. In this respect, it is most encouraging that YAA Dato' Abdul Hamid has himself set the tone for us in his appointment speech in December last year. In that speech, which has been described as &quot;a breath of fresh air&quot;, he openly addressed concerns about the impartiality of judicial decisions, the appointment and promotion of judges, and their commitment to carrying out their work. He wisely pointed out that whether or not these perceptions were founded was immaterial. The mere fact that they exist is enough to do damage and warrant firm action'. 
&#60;br /&#62;

Given that it is unlikely that the Judicial Appointments Commission would have been set up by the time the present Chief Justice Tun Abdul Hamid Mohamad retires on 18th October, 2008, it is almost a foregone conclusion that the proposed new Chief Justice will be recommended by the Prime Minister to Your Majesty for Your Majesty's consent, without the attendant transparent procedures that the anticipated Judicial Appointments Commission would have introduced.

We, the rakyat, again guided by the recent wise words of HRH Raja Nazrin Shah, that when the advice given to the Malay Rulers contradicts the spirit of the constitution, sanctity of the law and the basic principle of justice, the Malay Rulers should not feel pressured to give their assent and that the constitutional monarch system involves a sharing of power between the Rulers and the people and the Rulers are often the &quot;source of reference&quot; whenever there was a crisis among the rakyat, now pray that Your Majesty may be so moved, with a view to begin the process of restoring the confidence of the rakyat in the Judiciary :

1.to require that the senior most judge of the Federal Court, such seniority measured by the years of service in the apex court, be appointed as the next Chief Justice upon the retirement of the present Chief Justice Tun Abdul Hamid Mohamad retires on 18th October, 2008; and

2.pending the establishment of the Judicial Appointments Commission, to require that promotions to the Court of Appeal and to the Federal Court shall be from the senior most judges of the High Courts and Court of Appeal respectively.
